Will Ohio Ban Smoking in Cars?

COLUMBUS — Ohio lawmakers are considering a proposal to ban smoking in cars when there are passengers six or younger.

Dr. Robert Bates is a Cleveland Clinic physician who specializes in smoking risks impacting children.

“We do see increased inflammation and increased cardiovascular problems, particularly in children. We see problems of allergies  asthma and more bronchitis.  … There is no safe dose of cigarette smoke, particularly for children,” he said.

He believes the ban should be extended to 17 years and younger.  California is one of several states with such a ban and has the higher age.

    Brazil Bans Smoking Nationwide

    BRASILIA, Brazil — The Brazilian Congress has passed a bill banning smoking in enclosed public places nationwide.

    Smoking bans are already in Sao Paulo, Rio de Janeiro and other big cities.

    The new law goes one step further. It makes illegal designated smoking rooms in airports and bars that exist even in those places with a ban already in place.

    It also raises taxes on tobacco products and is forcing a minimum price on the products, increasing costs for consumers by up to 55 percent within four years.

        Outdoor Smoking Ban Takes Effect in Brooklyn

        The city’s outdoor smoking ban is now in effect, with smoking is outlawed in city parks, pedestrian plazas, beaches, boardwalks, marinas, public golf courses and sports stadia.

        City officials say the new law is expected to be enforced mostly by New Yorkers themselves, who are urged to call 311 if they spot smokers breaking the law.

        Violators will face a $50 fine, but only the city’s 200 Parks Enforcement Patrol officers can hand out those summonses. Those officers are also putting the emphasis on educating the general public.

        In a statement released Monday, Parks Department officials said: “The new smoking ban is a quality of life rule that is primarily self-enforcing. We’re counting on all New Yorkers to comply just as they do with other quality of life rules. Parks Enforcement Officers, who ensure quality of life issues in our parks and beaches, do have the ability to issue summonses to those who do not comply with parks rules, and when possible will educate and advise before taking further action when overseeing compliance.”

          E-Cigarettes Declared Illegal by FDA

          Sept. 9 (Bloomberg) — Electronic cigarettes sold in the U.S. are being marketed illegally as smoking-cessation aids, the Food and Drug Administration said.

          E-cigarettes and related products sold by five closely held companies require approval as drugs or medical devices because they’re promoted to help smokers stop or reduce use of regular cigarettes, the FDA said in warning letters posted today on the agency’s website. To sell the products, companies must conduct animal and human studies and apply for FDA clearance, the agency said in a separate letter to the Electronic Cigarette Association, a Washington-based industry group.

          $300 million Awarded Against Tobacco Company

          A jury in Broward County Thursday bestowed a record $300,590,000 verdict in opposition tobacco giant Phillip Morris, USA, including bona fide 4 million in punitive costs alone. The verdict is the biggest ever in Florida against a tobacco company. The suit was one of a number of lawsuits pending throughout the state of Florida after the Florida Supreme Court de-certified the class-action and compelled each claimant to bring their own individual lawsuit.

          Texas lawmakers need to pass statewide smoking ban

          Seven-time Tour de France champion Lance Armstrong last week put a famous face on the legislative battle to ban smoking statewide in public indoor places, including restaurants and bars.

          At a rally outside the Capitol, Armstrong invoked his own successful battle with testicular cancer in backing bills by state Rep. Myra Crownover, R-Denton, and Sen. Rodney Ellis, D-Houston. Armstrong was a visible supporter of the successful 2007 effort to issue billions in bonds to pay for cancer research. His foundation is helping fund a radio advertising campaign in support of the bill.

          This will be another vicious legislative fight despite a statewide poll released by Smoke-Free Texas showing 68 percent of Texans favor the ban.

          ‘Light’ Cigarette Suits Allowed by U.S. Supreme Court

          Dec. 15 (Bloomberg) — Smokers can sue over the marketing of “light” cigarettes, the U.S. Supreme Court ruled in a decision that bolsters billions of dollars in claims against Altria Group Inc.’s Philip Morris USA and other tobacco companies.

           

          The justices, voting 5-4, said a federal labeling law doesn’t shield cigarette makers from suits accusing them of deceiving consumers by describing cigarettes as “light” or “low tar.” The court also said federal oversight of cigarette testing didn’t preclude those lawsuits.

           

          Light-cigarette suits represent probably the most significant legal threat facing the tobacco industry, with dozens of smoker suits against Philip Morris, Reynolds American Inc.’s R.J. Reynolds Tobacco and other cigarette makers. Lights account for more than 80 percent of the U.S. market, according to federal figures.
